These are the Terms of Service ("Terms") of ASMY TECH, LLC (a company registered under the laws of the United States), with its registered office at 3433 W Orange Ave APT 19, Anaheim, CA 92804 US, telephone number +168923627008, and email address [email protected] (hereinafter referred to as "ASMY TECH, LLC", "we", "our", or the "Company").
These Terms govern the legal relationship between you (the "User" or "You") and ASMY TECH, LLC when using any ASMY TECH, LLC game, whether you access the games through a web browser, a social network site (e.g., Facebook), or through an application on a platform (e.g., Apple's "App Store", Google Play), collectively referred to as the "Platform".

Your Use of the Games
When you can use our games
In order to obtain the right to play our games, you represent that:
You own the device used to access and play each game.
You are not located in a country (i) that is embargoed by the U.S. government or designated by the U.S. government as a "terrorist supporting" country; and (ii) you are not on any U.S. government list of prohibited or restricted parties.
The information you provide to us is true and accurate, and you will update it as necessary.
You have not previously been prohibited or prevented from using any game or any Platform.
If you download any game from a Platform, you must have a valid account for that Platform ("Platform Account").
You will not:
Copy, sub-license, lease, license, lend, sell, trade, or otherwise handle or exploit the games or any Virtual Items;
Use the games or any Virtual Items for any illegal activity;
Use the games or any Virtual Items to disseminate any obscene, violent, threatening, defamatory, discriminatory, or other information or material that ASMY TECH, LLC deems offensive;
Use the games or any Virtual Items to disseminate any information or material that infringes or may infringe any intellectual property rights (including those of ASMY TECH, LLC).
You must be of a certain minimum age to play our games or use our services. The minimum age varies by country. Please see below for the minimum age in your country.
Minimum Ages:
16 years: France, Germany, Hungary, Lithuania, Luxembourg, Netherlands, Slovakia
15 years: Finland
14 years: Austria
13 years: All other countries
2. Acceptance of These Terms
If you have a Platform Account and download a game from the Platform, or otherwise participate in the games through a browser, website, or any other Platform, you are deemed to have accepted and agreed to these Terms. If you do not agree to these Terms, please do not download, play, and/or otherwise participate in the games, as such activities are not permitted without consent. You acknowledge that these Terms: (a) are effective from the date you first download our games; (b) apply to your use of any of our games and all Virtual Items; (c) constitute a legally binding contract between you and ASMY TECH, LLC, and not between you and any Platform provider. ASMY TECH, LLC is solely responsible for the games and their content, and the Platform provider bears no responsibility. ASMY TECH, LLC may change these Terms at any time without prior notice. If you do not agree to changes to the Terms, you must stop using the games. Your continued use of the games will be deemed acceptance of such changes.
3. Privacy Policy ("PP")
The information we collect about you (including personal data) and how we use such information is set out in our Privacy Policy. You can find this Privacy Policy on our website (e.g., https://www.asmytechteams.com/flies.html), where you can also download our games.
4. Special Terms
The terms and conditions of the Platform provider also apply to your use of the games and your purchase of Virtual Items ("Platform Terms"). In the event of any conflict between these Terms and the Platform Terms, the Platform Terms shall prevail to the extent related to the use of the Platform. In addition to the Platform Terms, depending on how you access the games, your use of our games is subject to other special terms and conditions. For example, if you access the games via Facebook's "Facebook Connect" feature, Facebook's Terms of Service may apply. Furthermore, we, our business partners, or other third parties may from time to time hold contests or promotions that may be subject to additional terms. All such terms are "Special Terms". In the event of any conflict between these Terms and the Special Terms, the Special Terms shall prevail.
5. Grant of License
In consideration of your agreement to be bound by these Terms, we grant you a non-exclusive, non-transferable, non-sublicensable, and revocable license to play our games for your personal, non-commercial entertainment purposes. You shall not attempt to crack or otherwise gain unauthorized access to any game or software. ASMY TECH, LLC owns (or has licensed the right to use) all rights, title, and interest in and to the games, including but not limited to any intellectual property (including all copyrights in the underlying software code, visual art and graphics, musical works and audiovisual effects, and all trademark rights in the game names, but excluding any User Content). Your use of our games through this license does not grant you any intellectual property rights in our games.
6. User Content
Any data, text, graphics, photographs, and other materials uploaded to the games or otherwise provided within the games by you or other users ("User Content") are the sole responsibility of the person from whom such User Content originated. ASMY TECH, LLC makes no guarantees regarding the accuracy, quality, or completeness of any User Content posted through the games. You agree that ASMY TECH, LLC shall not be liable for any User Content, including but not limited to any errors in any User Content or any loss or damage incurred as a result of the use of User Content.
You represent and warrant that the User Content you transmit or submit is original to you and that you exclusively own all rights, title, and interest in such content, including but not limited to intellectual property rights, including the right to grant all rights and licenses herein, and that ASMY TECH, LLC will not be subject to any third-party obligations or liabilities as a result of exercising such rights and licenses.
You hereby grant ASMY TECH, LLC a worldwide, irrevocable, perpetual, non-exclusive, transferable, fully paid-up, royalty-free license (with the right to sublicense) to use, copy, adapt, modify, distribute, license, sell, transfer, publicly display, publicly perform, transmit, stream, broadcast, and otherwise exploit the User Content you transmit or submit and all derivative works thereof. To the extent permitted by applicable law, you hereby waive any moral rights you may have in such User Content. User Content is not confidential and will not be returned to the user.
Notwithstanding the above license, with respect to profile pictures only, you grant ASMY TECH, LLC Interactive a non-exclusive, transferable, royalty-free, worldwide license to use your profile picture in accordance with applicable data protection laws and as further set out in the Privacy Policy (if the profile picture is a photo of a person). This license terminates if you delete the profile picture. ASMY TECH, LLC will not use your profile picture for marketing purposes unless prior consent is obtained from the person in the photo.
ASMY TECH, LLC reserves the right to remove and/or permanently delete any User Content from the games at its sole discretion.
7. Errors
ASMY TECH, LLC will make reasonable efforts to ensure that errors and mistakes in relation to pricing and your purchase and use of the games or Virtual Items do not occur. However:
ASMY TECH, LLC reserves the right to cancel any such manifest error or mistake, however it arises or occurs, e.g., where due to human error or technical failure the pricing for Virtual Currency is incorrect to give you the opportunity to profit therefrom. You will forfeit any Virtual Items obtained as a result of such error or mistake;
If you identify a material error in the published price or specifications when ordering Virtual Items in a game and contact ASMY TECH, LLC to inform us of this erroneous information, we will: (i) provide you with the correct price or specifications; (ii) ask you to confirm whether you wish to purchase the relevant Virtual Items at the correct price or specifications. If necessary, ASMY TECH, LLC will also state the validity period of the offer or price. If you choose not to complete the purchase at the corrected price or specifications, ASMY TECH, LLC will refund you in full any amounts you have already paid.
12. Availability of Virtual Items (Note: The original text jumps to section 12 here. The translation follows the original numbering.)
ASMY TECH, LLC reserves the right to limit the number of Virtual Items you may purchase within a specified period. Virtual Items may only be purchased and used by players in jurisdictions where such activities are permitted by applicable law. Virtual Items may only be purchased in-game or through other channels expressly authorized by ASMY TECH, LLC. ASMY TECH, LLC reserves the right to refuse any request to purchase Virtual Items for any reason.
8. Implied Terms
The express provisions of these Terms supersede and hereby deny all warranties, conditions, terms, undertakings, and obligations implied or incorporated by any collateral agreement, statute, common law, custom, usage of trade, course of dealing, or otherwise, all of which are hereby excluded to the fullest extent permitted by law.
9. Disclaimer
ASMY TECH, LLC provides the games and all Virtual Items to you "as is". ASMY TECH, LLC does not warrant that you will have uninterrupted, reliable, or fault-free access to any game. ASMY TECH, LLC does not warrant the accuracy, completeness, or reliability of any game. While ASMY TECH, LLC will make reasonable efforts to ensure that you have access to the games 24 hours a day, ASMY TECH, LLC is not liable if, for any reason, the games are unavailable at any time or for any period. Your access to the games may be temporarily suspended without notice in the event of system failure, maintenance or repair, or for reasons beyond ASMY TECH, LLC's control. ASMY TECH, LLC may also need to modify or maintain any game from time to time. In such event, ASMY TECH, LLC may suspend your access to the games or any part thereof, or close down the games indefinitely. If the game is downloaded from a Platform, you and ASMY TECH, LLC acknowledge that the Platform provider has no obligation whatsoever to furnish any maintenance or support services to you with respect to any of our games. You acknowledge that ASMY TECH, LLC, not the Platform provider, is responsible for addressing any product liability claims, any claims of violation of regulatory or legal requirements, or claims under consumer protection or similar legislation.
General
10. Account Termination or Suspension
ASMY TECH, LLC may, in its sole discretion, take the following actions at any time for any reason without prior notice:
Terminate or suspend your use of the games (in which case we may share your name and email address and notify third parties, including Platform providers); or
We may require you to provide certain documents to verify your information, and if we believe there are grounds to refuse your request to participate in the games, we will refuse your request.
11. Assignment of Rights and Obligations
ASMY TECH, LLC may assign its rights and/or obligations under these Terms to any third party, including the ability to sub-license and/or subcontract its rights and obligations under these Terms to any third party.
12. Severability (Note: This section appears to be numbered "12" again, following the original text's structure.)
If any provision of these Terms is held by a court or administrative body of competent jurisdiction to be illegal, invalid, or unenforceable in whole or in part under any laws or regulations, that provision or part thereof shall to that extent be deemed not to form part of these Terms, and the legality, validity, and enforceability of the remainder of these Terms shall not be affected.
13. Entire Agreement
These Terms constitute the entire agreement between us relating to the matters set out herein and supersede all other terms (including any terms and conditions you purport to apply). You are not entitled to rely on any agreement, understanding, or arrangement not expressly set out in these Terms.
